A Mexican federal judge has refused prosecutors’ request for arrest warrants against 22 workers at a daycare in the northwestern city of Hermosillo, where 49 children died and 70 were injured in a June 2009 fire, authorities said.

The Federal Judiciary Council, the top administrative body of Mexico’s judiciary, said in a statement Friday that Judge Ricardo Ruiz del Hoyo Chavez in Hermosillo, capital of Sonora state, issued the ruling.

The federal Attorney General’s Office had requested the arrest orders, accusing the daycare workers of culpable homicide by omission, culpable injuries (non-life-threatening) and culpable injuries by omission (life-threatening).

The workers neglected their duty to ensure the safety of the children by not taking action to evacuate all of them from the facility, the AG’s office argued.

But the judge said the evidence shows that the workers, although they were unable to evacuate all of the children, took action to rescue many of them.
