México’s Supreme Court overruled a 2013 amendment to Colima’s civil code that attempted to apply its marriage laws differently to same-sex couples.
The law differentiated between the conjugal relationship of a heterosexual couple and a homosexual couple.
Under the Colima law “marital relations” are divided into marriage, which a civil contract between one man and one woman and a “conjugal bond” which is a civil contract between two people of the same sex.
The Supreme Court said that to deny access to marriage to homosexual couples, even if there is a different legal contract which is available to them, evokes the doctrine of “separate but equal,” in which makes the contract unjustified and discriminatory.
