Marriages formed by people of the same sex will be subject to regular membership scheme of Social Security in Mexico.
The Mexican Supreme Court of Justice declared last January 31 that marriages between people of same the sex have exactly the same rights as regular marriages, and therefore, they have the right of affiliation to the Mexican Social Security Institute (IMSS).
This was officially announced in a Social Security statement this week, which clearly states that “gay” couples will be subject to a regular membership scheme of Social Security.
”This determination is consistent with the interpretation given by the Supreme Court to the Social Security Act, in the sense that since this law makes no distinction based on gender, it is understood that the law also protects same sex marriages, respecting the “pro persona” principle (principio pro persona), established in the Political Constitution of the Mexican United States ”, says the IMSS statement.
In 2006, the Mexico City Government launched the inciative known as “Society Affair Law” (Ley de Sociedad de Convivencia), that could be signed by persons of the same sex. Later on, in 2009, the concept of marriage is redefined and in March 2010 a number of amendments to the Civil Code and the Code of Civil Procedure of the Federal District, officially allowed the celebration of same sex marriages. And by the end of 2013, more than 700 weddings were held in Mexico City.
